Could there be a "greater" GPL which explicitly declares that the constraint extends to use of the code as statistical data, such as in machine learning models?

Posting code to github gives github a license to use the code to basically whatever they want regardless of conditions in other licenses. And there's a case that their use of any public code is transformative and thus does not require permission from a rights holder. The laws are always lagging behind.
