A recruiter presented me to a Company for a 3 months Freelance Position. Unfortunatley I got rejected, however I kept Contact with the Company and i asked for a fulltime employment, they were fine with that and i got a tech Interview Next Week with them. Now my recruiter contacted me and Knew already about everything, they kept asking me what they should negotiate with them. I told them i will negotiate myself as I am looking forward to a full Time employment with them, they tell me it has to be under their name, eventhough it has nothing to do with the agreed freelancing position.. are they allowed to do that ?

    Read your contract with them. You may have agreed to that arrangement when you signed on with the recruiting firm.

    Technically you are under no obligation to them (recruiters). If they wish to seek recompense then they should have discussions directly with the company that wishes to employ you, they will likely be unsuccessful. It is your employer that pays them and you have done no crime.

    @iceman so they have no proof. No need to do anything about them, but tell them that you postulated on your own and that if the continue on harrasing you you will talk about this harassment to your future employer

    Did you sign a contract with the recruiter? Even so- depending on where you are located - most states are "right to work" states which means contracts can't prevent you from taking or leaving a job.

    Tell the recruiter you do not want to work with them or ask the company if they would prefer to just work with you directly. The recruiter only wants to make their cut and I have found they have botched jobs because their fee was to high.

    In most cases, it's the company that signs the contract with the recruiter. But your situation is pretty straight forward and you do not have to use the pushy recruiters. Good luck!

    @iceman I don't think it's that much different from Germany. On my last contract job I had many colleagues from foreign countries such as Canada, Turkey, Ireland, India etc. most of them were freelancers getting payed dutch rates.

    Just remember, if you should need them in the future, they may not help
